A considerable number of books and papers have analyzed normative concepts using new techniques developed by logicians; however, few have bridged the gap between the English legal culture and the Continental tradition in legal philosophy. This book addresses this issue by offering an introductory study on the many possibilities that logical analysis offers the study of legal systems. The volume is divided into two sections: the first covers the basic aspects of classical and deontic logic and its connections, advancing an (...) explanation of the most important topics of the discipline by comparing different systems of deontic logic and exploring some of the most important paradoxes in its domain. The second section deals with the role of logic in the analysis of legal systems by discussing in what sense deontic logic and the logic of norm-propositions are useful tools for a proper understanding of the systematic structure of law. Our goal was to explore self‐care practices among men who have sex with men in the context of Mpox in Brazil. This study used qualitative research methods, including interviews and thematic analysis, to collect and analyze data from male participants across the Brazilian territory. The narratives unveil men's perspectives on self‐care, risk reduction, and health beliefs during the Mpox pandemic. Our findings highlight a multifaceted approach to self‐care among men, encompassing hygiene, physical contact management, mask usage, skin lesion vigilance, and (...) adherence to official guidelines. Men's attitudes toward sexual behaviors emphasize the importance of reducing sexual partners, practicing safe sex, and combating misinformation through accurate information dissemination. The development of these behaviors and self‐care practices can be facilitated by nurses guided by Dorothea Orem's Self‐Care Theory, supported by patient‐centered care, with strategies to address and confront the stigma associated with the disease and provide emotional support. Thus, the study underscores the pivotal role of self‐care in mitigating infection risks, especially in the context of emerging infectious diseases. It acknowledges the impact of socio‐cultural factors and healthcare policies on men's preventive measures. However, it also recognizes limitations, such as potential bias due to stigma concerns and a nonrepresentative sample. Ultimately, the research advocates for tailored education, promotion of gender equity, and healthcare empowerment to effectively manage health risks in such contexts. (shrink)

Cet article propose une lecture critique du Despotisme de la Chine, un texte riche mais peu commenté, où Quesnay expose explicitement le contenu de sa pensée politique. Par l’analyse de Despotisme de la Chine nous voudrions défendre trois idées qui font sens autour de la représentation de la Chine qui est faite par Quesnay. La première est naturellement de montrer en quoi ce texte est représentatif de la pensée de Quesnay (et, plus largement, de l’école des physiocrates). La deuxième est (...) de souligner que le cas de la Chine, tel qu’il est vu par Quesnay, permet de penser l’économie en tant qu’activité, discipline, ou même science qui se situe au cœur du fondement de la philosophie politique qu’il avance. La troisième est d’indiquer comment la compréhension des logiques économiques d’après Quesnay relève finalement d’une observation intelligente du réel, de lier la loi positive (le politique fondé par l’économique, pour ce qui est alors connu de la Chine) et la loi naturelle (en somme : ce qui est et ce qui doit être). Au cœur de ces trois vues se trouve une réflexion sur ce pays lointain et nul autre (sinon la France). Loin d’être un simple prétexte pour avancer ses arguments, la Chine est surtout une façon de voir, de révéler, de saisir la nature d’une pensée (la physiocratie), d’une discipline (l’économie), et de sa portée (la science et le politique). ABSTRACT This paper is on the justification of, the epistemic principle defended by M. Huemer in his Phenomenal Conservatism theory. Put in a straightforward way, we can ask: what reasons are there for thinking that is true, that is, for thinking that appearances justify beliefs? This question corresponds - to use L. BonJour’s vocabulary - to the demand for a “metajustification”. The pursuit of this metajustification can take different directions, depending on the general conception or nature of epistemic justification we (...) are working with and on who is supposed to satisfy the demand. Unfortunately, all of these directions seem to lead to a dead end. In other words, the apparently fair and even essential demand for a metajustification of cannot be met by the theory, at least in a satisfactory way. If we are right about that, it will remain the difficult question whether Phenomenal Conservatism is the only one to be blamed for this failure. We will briefly talk about that in the conclusion. Features of threatening cues and the associated context influence the perceived imminence of threat and the defensive responses evoked. To provide additional knowledge about how the directionality of a threat (i.e. directed-towards or away from the viewer) might impact defensive responses in humans, participants were shown pictures of a man carrying a gun (threat) or nonlethal object (neutral) directed-away from or towards the participant. Cardiac and electrodermal responses were collected. Compared to neutral images, threatening images depicting a gun directed-towards the (...) participant induced sustained bradycardia and an increased electrodermal response, interpreted as immobility under attack. This defensive immobility reaction is evoked by high perceived threat and inescapable situations and indicates intense action preparation. Pictures of guns directed-away from the participant induced shorter bradycardia and no significant modulation of the electrodermal response compared to neutral pictures, which might be consistent with the perception of a less threatening situation. The results show that the directionality of threat stimuli is a key factor that prompts different patterns of defensive responses. (shrink)

Marion titulada, dedicada a la unión de alma y cuerpo, y cuya tesis principal es: los problemas que esta unión suscita confunden dos términos, cuerpo y mi cuerpo. Esta confusión lleva a que se apliquen al primero categorías propias del segundo. Se examinan las "paradojas ónticas" que mi cuerpo (la carne) inaugura (a); se despeja la tesis de dos interpretaciones de las meditaciones primera y sexta (b); se discute la (...) "excepción a la metafísica" instaurada por el conocimiento de mi cuerpo (c); se arriesga, siguiendo una indicación del autor, la apertura a una dimensión ética que exige examinar ya no la unión de cuerpo y alma, sino la unión por el amor a un semejante y a la comunidad de semejantes (d). -/- The article carries out a critical examination of J.-L. Marion's latest work, "Sur la pensée passive de Descartes", whose main thesis is that the problems posed by the union of body and soul confuse two terms: body and my body. This confusion leads to the application to the former of categories inherent to the latter. The paper examines the "ontic paradoxes" that my body (the flesh) gives rise to (a); it clarifies the thesis of two interpretations of the First and Sixth Meditations (b); it discusses the "exception to metaphysics" established by the knowledge of my body (c); and, following an indication by the author, it proposes an opening to the ethical dimension, which demands an examination of the union, through love, with a fellow human being and with the community of human beings, rather than of the union of body and soul (d). -/- Neste artigo, propõe-se um exame crítico da última obra de J.-L. O ceticismo acadêmico se encontra utilizado na formulação dos preceitos epistêmicos para a reformulação da ciência, nas _Règles Pour La Direction De L’Esprit _ ( 1701, Amsterdam, texto póstumo e inacabado). O probabilismo de Carnéades, compreendido como o principal vetor do ceticismo acadêmico na modernidade, fundamenta a certeza. Outras teses para a correção epistêmica do espírito parecem advir da tradição acadêmica, como a de fi nição de _science _ como _sagesse_, por exemplo ( _Règle _ _I_ ). Desse modo, a (...) busca da verdade (coordenada principal das _Règles_, como nos evidencia a _Règle _ _IV_ ) não abdica do ceticismo. Tratar-se-á, neste artigo, de compreender que o probabilismo acadêmico aparece no projeto de busca da verdade das _Règles _ de modo negativo _, _ pois Descartes ataca a modalidade do provável. Outros tópicos acadêmicos aparecem em questão, como a busca de sabedoria, a mitigação da dúvida, a disciplina do assentimento pela recusa do provável e a verdade do fi deísmo _. _ Estes tópicos se resumem ao método acadêmico, de fi nido pela recursividade epistêmica. Ce livre propose d'aborder la pensée de Charles Taylor par ce qu'il reconnaît être son centre de cohérence : "l'horizon moral de signification". D'entrée de jeu, il situe assez clairement Taylor dans le vaste horizon de la philosophie morale contemporaine. Le texte pose bien l'originalité de la conception taylorienne de l'ontologie ; ses idées d'incarnations, d'engagement et la relation incontournable du moi. Sans complaisance, il montre le rôle central que joue cet horizon dans la philosophie morale taylorienne tout en exposant (...) les zones d'ombre où Taylor est moins clair ou moins explicite dans sa pensée. En illustrant clairement le lien entre l'horizon moral et l'identité d'une part, et celui entre les horizons et le dialogue interculturel d'autre part, le livre enrichit les analyses existantes sur le sujet. Il expose le dilemme taylorien entre contexte et universalisme. L'originalité de Taylor réside dans la manière dont il repose ce dilemme conservant en tension ces deux axes; orienter sa vie en fonction du bien nous oblige à naviguer entre deux eaux. La question du dialogue interculturel est naturellement incontournable dans le présent débat avec Taylor. Les considérations sur le "langage des contrastes" et le passage par les écrits de Raoul Fornet-Betancourt sont tout à fait pertinents. En effet, l'interculturalité ou le dialogue interculturel appelle un nouveau langage, mais les conditions de celui-ci? et son statut ontologique d'ailleurs ne sont pas clairement exprimées dans les écrits tayloriens. Et ils peuvent difficilement l'être, car cela demeure pour lui de l'ordre du mystère et du dévoilement. L'ouverture à l'autre et à l'altérité est un chemin qui mène à plusieurs inconnus et appelle ce que Taylor nomme une transformation."--Page 4 of cover. (shrink)

O presente trabalho visa apresentar algumas considerações em torno do confronto/encontro entre filosofia e literatura. A produção ficcional de Clarice Lispector, no âmbito da literatura brasileira contemporânea, nos fornece a oportunidade de analisarmos a obra de arte a partir de um enfoque interdisciplinar.Nous présentons ici quelques considérations concernant la confrontation/rencontre entre la philosophie et la littérature. Dans la littérature brésilienne contemporaine, l'oeuvre de Clarice Lispector nous offre l'occasion d'analyser l'oeuvre d'art d'un point de vue interdisciplinaire.

In Entities and Indices, M. J. Cresswell argued that a first-order modal language can reach the expressive power of natural-language modal discourse only if we give to the formal language a semantics with indices containing infinite possible worlds and we add to it an infinite collection of operators $${{\varvec{actually}}}_n$$ actually n and $$ Ref _n$$ R e f n which store and retrieve worlds. In the fourth chapter of the book, Cresswell gave a proof that the resulting intensional language, which (...) he called $${\mathscr {L}}^*$$ L ∗, is as expressive as an extensional variant of it, called $${\mathscr {L}}$$ L, which has full quantification over worlds. In both linguistics and philosophy, Cresswell’s book has been viewed as offering a compelling argument for preferring extensional systems in the study of natural language. In this paper, after providing a model-theoretic definition of the relation being as expressive as that can be applied to Cresswell’s languages $${\mathscr {L}}$$ L and $${\mathscr {L}}^*$$ L ∗, we show that the intensional language $${\mathscr {L}}^*$$ L ∗ is not as expressive as the extensional language $${\mathscr {L}}$$ L. This result, we claim, undermines Cresswell’s argument to the effect that English modal discourse has the power of explicit quantification over worlds. Additionally, we show that $${\mathscr {L}}^*$$ L ∗ does become as expressive as $${\mathscr {L}}$$ L when we add Cresswell’s operator of universal modality $$\square $$ □ to $${\mathscr {L}}^*$$ L ∗, which provides an extra amount of expressive power. Recently, I. Yanovich has advocated a view that is similar to ours in important respects. At the end of the paper we offer a short discussion of his formalism. (shrink)

A saber, o bien la paradoja se aplica a la práctica del derecho y esta es indeterminada e imposible, o bien aquella es completamente irrelevante para la práctica del derecho y la reflexión filosófica sobre este. Se sugiere que la filosofía del derecho puede aceptar la relevancia de esta paradoja y obtener nuevos elementos a partir (...) de ella. ABSTRACT The article questions the two conclusions attributed to the application of "Wittgenstein's skeptical paradox" to law, as developed by S. Kripke: that is, either the paradox is applied to the practice of law and it is indeterminate or impossible, or the paradox is completely irrelevant for the practice of law and for philosophical reflection in that respect. The paper suggests that philosophy of right can accept the relevance of the paradox and draw new elements from it. (shrink)

O presente trabalho argumenta, a partir do filósofo Ludwig Wittgenstein, que o jogo de linguagem pode contribuir na discussão sobre educação. Objetivamos introduzir a percepção da linguagem como elemento inerente ao ser humano para abordar a relação sobre educação. Diante desse panorama, o trabalho discute as possibilidades dos jogos de linguagem, onde há regras que podem ser ou não as mesmas entre um jogo e outro. Jogar não significa ganhar, ter razão ou a verdade. Podemos jogar pelo prazer de inventar (...) um jogo ou para fazer valer argumentativamente nossa opinião. As considerações finais apontam para o desafio da pesquisa em educação, na disciplina de Paradigmas Filosóficos da Educação e provocam desafios na área da pesquisa filosóficoeducacional.Le présent travail argumente, à partir du philosophe Ludwig Wittgenstein, que le jeu de langage peut contribuer dans la discussion sur éducation. Nous objectivons introduire la perception du langage comme élement inhérant à l’être humain pour aborder le rapport sur éducation. Devant ce panorama, le travail discute les possibilités des jeux de langage, où il y a des règles qui peuvent être ou ne pas être les mêmes entre un jeu et l’autre. Jouer ne signifie pas vaincre, avoir raison ou la vérité. Nous pouvons jouer par le plaisir d’inventer un jeu ou pour faire valoir argumentativement notre avis. Les considérations finales objectivent pour le défis de la recherche en éducation, dans la discipline de Paradigmes Philosophique de la Éducation et causent des défis dans le domaine de la recherche philosofique-éducationale. We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. En este trabajo ofrezco un análisis de algunas de las ideas más importantes sostenidas por Ricardo Caracciolo en su ensayo sobre hechos y justifi cación de las decisiones judiciales. Estas tesis son: a) tesis de la aplicación posible. Las normas generales sólo se pueden aplicar a los casos que ellas regulan; b) tesis de la aplicación efectiva. Una norma general es aplicada a un hecho sólo si la premisa que describe ese hecho es verdadera. Este artículo muestra que hay buenas (...) razones para revisar ambas tesis ya que ellas pasan por alto una distinción relevante entre distintos sentidos de ‘casos individual’: casos individuales de un universo del discurso y casos individuales de un caso genérico. Como consecuencia de ello, se señala que es necesario modelar un concepto de justifi cación jurídica que no presuponga a esas mencionadas tesis. (shrink)

Este trabajo es una crítica a la distinción entre lagunas de conocimiento y reconocimiento. En Normative Systems, Alchourrón y Bulygin sostienen que estas indeterminaciones en la aplicación del derecho son problemas diferentes. Según AB, las lagunas de conocimiento surgen por nuestro deficiente conocimiento de las circunstancias del caso, pero las lagunas de reconocimiento se producen por la vaguedad del lenguaje. Para resolver las lagunas de conocimiento, los juristas usan presunciones y para resolver las lagunas de reconocimiento es preciso redefinir los (...) conceptos. Sin embargo, AB no ofrecen una reconstrucción específica de la vaguedad y ello afecta al análisis de esos tipos de lagunas. En particular, AB creen que la vaguedad es un problema epistémico y, por ello, un sistema completo puede ofrecer una respuesta correcta para cada caso individual aun cuando no podamos conocer esa solución. Pero, cuando se asume que la vaguedad es un problema epistémico, entonces no existen mayores razones para distinguir entre lagunas de conocimiento y lagunas de reconocimiento. This paper analyzes the distinction between gaps of knowledge and gaps of recognition. In Normative Systems, Alchourrón and Bulygin claim that both indeterminacies are different problems that arise in the application of general norms to individual cases. Where through ignorance of certain properties of the facts, we cannot determine whether an individual case belongs to a generic case, we speak of gap of knowledge. On the contrary, gaps of recognitions are caused by the semantic indeterminacy of the concepts which define a generic case. In order to solve gaps of knowledge, jurists use legal presumptions, but the solution of a gap of knowledge requires the redefinition of a certain concept. However, AB believe that vagueness is only an epistemic problem. For this reason, they conclude that a complete normative system resolves every possible individual case even though we can still find epistemic indeterminacies. However, this paper shows that if vagueness is characterized as an epistemic problem, there will be no relevant reason for stressing the distinction between gaps of recognition and gaps of knowledge. Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la versión (...) fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)

In this paper, I consider some problems concerning the structure of legal systems. In order to do this, I basically analyze the promulgation and derogation of legal rules. Frequently, promulgation has been referred to as the introduction of a rule into, and derogation as the removal of a rule from, a normative system. I try to show that there is more to it than that. One of the main ideas of the paper is that the enactment or derogation of a (...) legal rule by an authority na restricts the competence of all lower authorities: Once a rule R has been enacted by an authority na, authorities inferior to na cannot remove R from the normative system; and when R has been derogated by na, lower authorities do not have the competence to introduce R into the system. Further important questions include: What happens with derogated rules? What is the structure of the set of derogated rules? When does a rule belong to a derogated set, and when is it removed from a derogated set? These questions are very important for a theory of legal systems, and I try to give some possible answers. Perhaps the main conclusion of the paper is that promulgation and derogation can be considered very similar processes with respect to legal systems. (shrink)

The current article aims to provide an up-to-date synopsis of available techniques to study affect dynamics using intensive longitudinal data. We do so by introducing the following eight dichotomies that help elucidate what kind of data one has, what process aspects are of interest, and what research questions are being considered: single- versus multiple-person data; univariate versus multivariate models; stationary versus nonstationary models; linear versus nonlinear models; discrete time versus continuous time models; discrete versus continuous variables; time versus frequency domain; (...) and modeling the process versus computing descriptives.
